NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND

NOTICE OF INTENT TO REQUEST RELASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of North Little Rock.

 

REQUEST FOR RELEASE OF FUNDS

 

On or about September 1, 2021 the City of North Little Rock will submit to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds authorized under Title 1 of the Housing and Community Development Act of 1974, Public Law 93-383, as amended 42 U.S.C 5301 et seq.  to undertake  two Street and Drainage Improvement projects. One project is located at West 49th Street from Parker Street to Pike Avenue.  The second project is Park Place Street.  The funding amount is $176,966.67 for Park Place Street and $176,966.68 for West 49th Street in CDBG funds/Program B-21-MC-05-0005. In addition to the request of release of funds from the CDBG funds/Program B-21-MC-05-0005, the City will include in the release of funds  additional funding  from the CDBG funds/Program B-20-MC-05-0005 the amounts of $178,000 for the Park Place Street project and $178,000 for the West 49th Street project from Parker Street to Pike Ave. 

 

FINDING OF NO SIGNIICANT IMPACT

 

The City of North Little Rock has determined that the project will have no significant impact on the human environment.  Therefore, and Environmental Impact Statement under the National Environment Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Community Development Agency of the City of North Little Rock located at 500 W. 13th Street, North Little Rock, AR 72114 and may be examined between 8 am and 4 pm. 

 

PUBLIC COMMENTS

 

Any individual, group or agency disagreeing with this determination or wish to comment on these projects may submit written comments to the Community Development Agency of the City of North Little Rock at 500 W. 13th Street, North Little Rock, AR 72214 by September 1, 2021 at 10 am.  All comments received by this time and date will be considered by the City of North Little Rock prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing. 

 

ENVIRONEMTAL CERTIFICATION

 

The City of North Little Rock certifies to HUD that Terry C. Hartwick, Certifying Officer, in his capacity as Mayor consents to accept the jurisdiction of the Federal courts if any action is brought to reinforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorizes and allows the City of North Little Rock to use Program funds.

 

 

OBJECTIONS TO RELEASE OF FUNDS

 

HUD will accept objections to its release of funds and the Community Development Agency of the City of North Little Rock certification received by September 16, 2021 or a period of fifteen (15) days following the anticipated submission date of its actual receipt of the request (whichever is later) only if they are on the following bases:  (a) the certification was not executed by the Certifying Officer of the City of North Little Rock; (b) the City of North Little Rock has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58: (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR part 58 before approval of release of funds by HUD; or (d) another Federal agency acting  pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be address to HUD Arkansas Office, 425 West Capital, Suite 900, Little Rock, AR 72201.  Potential objectors sold contact HUD to verify the actual date of the objection period.
